The FCC released a Notice of Inquiry, seeking input on the future of the Universal Service Fund (USF), as required by the Infrastructure Investment and Jobs Act (IIJA). Specifically, the Commission is evaluating the implications for the current USF system of the $65 billion in broadband funding provided by the IIJA. The FCC must submit a report of its findings to Congress discussing how the Commission can improve its effectiveness in achieving universal service goals for broadband. The Notice of Inquiry also seeks comment on potential rule or statutory changes that would update the USF contribution system. Comments are due January 18, 2022, with reply comments due January 31, 2022. https://www.mondaq.com/unitedstates/telecoms-mobile-cable-communications/1144398/tech-telecom-weekly--december-20-2021?email_access=on (Interim editor's note: The actual NOI is at https://docs.fcc.gov/pubilc/attachments/FCC-21-127A1.pdf)

In it's renewed challenge to the net neutrality rules imposed by the FCC, Verizon is citing its First Amendment right to free speech. The argument itself seems dubious, but if Verizon wins it could lead to unintended consequences it might like even less. First, a little background on net neutrality itself. The framework of rules developed by the FCC is intended to ensure an even playing field for all on the Internet, and prevent Internet service providers (ISPs) like Verizon or Comcast from blocking certain content, or giving preferential treatment to other content. https://ecfsapi.fcc.gov/file/7021985929.pdf

The Enforcement Bureau of the Federal Communications Commission has entered into a Consent Decree to resolve its investigation into a service-wide network outage experienced by Cellco Partnership d/b/a Verizon Wireless (Verizon) in May 2020 that resulted in failed calls to 911. Congress has made emergency communication services a national priority, and the Commission has repeatedly emphasized that robust and reliable 911 service must be available nationwide. It is therefore incumbent upon the Commission to ensure that telecommunications carriers provide reliable 911 service at all times. To settle this matter, Verizon will implement a compliance plan and pay a $274,000 civil penalty. 2. After reviewing the terms of the Consent Decree and evaluating the facts before us, we find that the public interest would be served by adopting the Consent Decree and terminating the referenced investigation regarding Verizon's compliance with sections 9.4 and 9.10(b) of the Commission's rules https://docs.fcc.gov/public/attachments/DA-21-1503A1.pdf
