Fox (Boston) , Joshua Briones (Boston), Jonathan P. Garvin (Washington, DC) and Natalie A. Prescott (Boston) We are pleased to present our latest Monthly TCPA Digest, providing insights and news related to the Telephone Consumer Protection Act (TCPA). In our Regulatory Update, we look at whether ringless voicemail ("RVM") technology constitutes a "call" under current TCPA and FCC rules following the latest petition filed by Perdue for Senate, Inc. earlier this month. We also cover the status of the FCC's Robocall Mitigation Database now that the FCC has, as of July 1, 2021, implemented the STIR/SHAKEN caller ID authentication standards that it announced in a March 2020 Report and Order. In addition, we report on the strong support shown for the USTelecom Industry Traceback Group after ZipDX submitted a letter of intent to be designated as the registered traceback consortium. Finally, we continue our discussion on the FCC's online portal for submitting information on suspected robocalling and spoofing campaigns. In addition to adopting rules for the newly established reporting system, the Consumer and Government Affairs Bureau (CGB) issued its Second Robocall Blocking Report, noting improvements in quality and quantity of call blocking and labelling services. https://www.mondaq.com/unitedstates/telecoms-mobile-cable-communications/1092482/monthly-tcpa-digest--july-2021?email_access=on

Fox (Boston) and Jonathan P. Garvin (Washington, DC) The FCC adopted rules establishing a new reporting system for private entities to alert the FCC Enforcement Bureau directly of suspected robocalling and spoofing campaigns. As we reported in June, the new online portal was established pursuant to a directive in the TRACED Act to streamline the ways in which a private entity may share information related to unlawful robocalls and caller ID spoofing. The Enforcement Bureau may use the information submitted to the portal to open investigations or work with partners like the Traceback Consortium to stop robocalling campaigns quickly. https://www.mondaq.com/unitedstates/technology/1092564/tcpa-regulatory-update-fcc-adopts-rules-for-private-entity-robocall-reporting-and-releases-second-call-blocking-report?email_access=on

Duguid et al., 141 S. Ct. 193 (2020), issued on April 1, 2021, in which the Court unanimously held that the TCPA covers only random-fired calls and texts to cell phones from an automatic telephone dialing system (ATDS). Facebook overturned a U.S. Court of Appeals for the Ninth Circuit ruling in which the appellate court broadly defined the type of ATDS covered under the TCPA.
