In the past, I have responded to reports like this by recommending
wider adoption of end-to-end encryption, but I'm not sure that's
enough anymore. The data CISPA will allow the government to access
includes so-called "Traffic" intelligence, i.e., the records of who
emailed whom. They have some of it already, but CISPA will
allow investigators to access forwarding and other information that
wasn't previously available without a warrant.
Traffic intelligence can, unfortunately, lead to "guilt by
association" problems: if you call a pay phone that's used by a local
drug dealer, that doesn't necessarily mean that you bought drugs - but
I have seen, first hand, how easily panic can sweep a government and
its minions, and how misjudgements can compound each other until
ordinary men are caught in a web of inferences that becomes
self-sustaining.

Wednesday, the House Permanent Select Committee on Intelligence marked
up the Cyber Intelligence Sharing and Protection Act (CISPA), the
misguided "cybersecurity" bill that would create a gaping exception to
existing privacy law while doing little to address palpable and
pressing online security issues. The markup was held entirely behind
closed doors - even though the issues being considered will have
serious effects on the liberty of Internet users - and was passed out
of the committee.

A crackdown on cellphones and other electronics that began Monday at
the busiest criminal court facility in the country led to lines at
storage kiosks and frustrated some visitors but caused no major
problems, Cook County sheriff's officials said.
Visitors entering at the Leighton Criminal Court Building at 26th
Street and California Avenue were met by sheriff's deputies shouting
from the top of the main steps that cellphones were not being allowed
inside. Signs warning of the ban have been on display for months,
including in the parking areas around the courthouse.
Inside the lobby security area, those who were not able to stow their
smartphones, computer tablets or other electronic devices in their
car were directed to two storage kiosks charging $3 each to slip the
item in a plastic bag and stash it in a small locker with a sliding
door.

A recent enforcement crackdown on motorists who were using cell
phones while driving in five north suburban communities netted nearly
300 violations and more than 200 warnings, according to the agencies.
>From April 1-5, police departments in Highland Park, Deerfield,
Winnetka, Lake Forest and Waukegan took part in a joint initiative to
publicize their local cell phone bans and pull over scofflaws.
The five departments issued the following:
* 293 citations and 219 warnings for handheld cell phone use while
driving violations;
* 20 citations and one warning for the state ordinance against using
hand-held cell phones while driving in a school zone;
* Two citations for the state ordinance prohibiting texting and driving.

The entertainment industry has a long, long history of claiming that
if copyright law doesn't go their way, they'll all go out of
business. It's the adult version of "if you don't do it my way, I'm
taking my ball and going home." If court cases don't go their way, or
if the law isn't changed, we've been told over and over and over
again for the last century (and more frequently in the last two
decades) that the industry will take its ball and go home, because
they won't create under such awful circumstances (even if those
circumstances really aren't particularly different than they've
operated under for years). The latest? First, Fox's COO, Chase Carey,
claims that if they lose the Aereo case, they might shut down Fox,
the network TV channel, and move all its content to cable TV channels.
