Subject: Public-Safety Broadband Network: Congressional Action
Required to Ensure Network Continuity
Legislation set up an independent authority (FirstNet) to create a
nationwide broadband network for first responders, such as police
officers and firefighters. FirstNet contracted with AT&T to deploy the
network, which will be fully operational in 2023.
But this law terminates FirstNet's authority in 2027, and doesn't
identify another federal agency to oversee network operations or
updates. Without legislative action, the public-safety network will be
at risk and first responders could lose service.
Congress should consider reauthorizing FirstNet before the 2027 end
date to ensure network continuity.
University researchers in Texas use FirstNet to test emergency
communication services in a disaster training exercise.

T-Mobile Data Breach to Take Steps to Protect Their Personal
Information
HELENA - After nearly 37,000 Montanans had their personal information
compromised by a massive T-Mobile data breach, Attorney General Austin
Knudsen is urging all Montanans who may have been impacted to take
appropriate steps to protect their information from identity
theft. T-Mobile announced the breach last year but compromised
information has recently been for sale on the dark web. Montanans do
not need to be current customers of T-Mobile to have been affected
On August 17, 2021, T-Mobile reported a massive data breach impacting
53 million current, former, and prospective T-Mobile customers
nationwide. In Montana, that included 2,752 customers and 34,071
former or prospective T-Mobile customers. Among other categories of
impacted information, millions had their names, dates of birth, Social
Security Numbers, and driver's license information compromised.

Subject: Blunt Presses FCC Nominee Gigi Sohn on Failure to Disclose
Information Relating to Locast Settlement
WASHINGTON - During a U.S. Senate Commerce Committee hearing today,
U.S. Senator Roy Blunt (Mo.) questioned Gigi Sohn, who has been
nominated to serve as Commissioner of the Federal Communications
Commission, about information she withheld at a previous hearing
relating to the settlement reached between Locast, where she served as
a board member, and television networks that successfully sued for
copyright violations. Blunt also questioned Sohn about omitting her
involvement with Locast in a recusal letter she signed last month.

We are pleased to present our latest Monthly TCPA Digest, providing
insights and news related to the Telephone Consumer Protection Act
(TCPA). In this issue's Regulatory Update, we cover a proposed
Declaratory Ruling circulated by FCC Chairwoman Rosenworcel that would
require callers to obtain consent from consumers before delivering
"ringless voicemail" messages directly to their voicemail
mailboxes. We also discuss the FCC Enforcement Bureau's
cease-and-desist letters to Great Choice Telecom and TCA Voip,
resulting from their alleged transmission of illegal robocalls.
In our Litigation Update, we look at what constitutes a "voice"
post-Facebook. While some plaintiffs have argued that a text message
can be considered a "voice" under TCPA and may thus constitute a TCPA
violation, a district judge in the Central District of California
recently concluded that the argument defies common sense.
