We are pleased to present our latest Monthly TCPA Digest, providing
insights and news related to the Telephone Consumer Protection Act
(TCPA). In the past month, the FCC has continued to signal its intention
to aggressively pursue illegal robocalling, Chairwoman Jessica
Rosenworcel circulated proposed rules that would require mobile wireless
providers to block illegal text messages, and on October 21, the FCC's
Enforcement Bureau issued letters to three additional network providers
demanding they "immediately cease originating illegal robocall campaigns
on their networks."
We also report on the debut of the FCC's Reassigned Numbers Database
(RND), which went live on November 1. To help protect themselves from
TCPA liability, callers should establish protocols for checking their
information against the database.

On November 1, 2021, the Federal Communications Commission (FCC)
announced the launch of the Reassigned Numbers Database (RND). This
centralized database is an important development for businesses across
industries that are engaged in calling and/or text messaging activities
directly or through third-party vendors. It should help companies ensure
they are reaching the intended recipients of their communications. In
addition, calls and text messages to reassigned telephone numbers have
given rise to significant TCPA litigation, aggregate damages exposure,
and settlements. There is now an authoritative method by which
businesses can mitigate that risk and avail themselves of a liability
safe harbor.
