Section 230 Reforms

Continuing its intense focus on internet platforms' role in political
debate and the liability protections they receive under the Communi-
cations Decency Act (CDA), 47 U.S.C. § 230, the Trump Administration
this week submitted a legislative proposal that would substantially
limit platforms' Section 230 immunity. The Administration's legis-
lative proposal joins several other bills that take aim at platform
immunity. It is unclear whether any of these proposals will advance in
the near term, but the proposals are a sign of sustained, bipartisan
concern about the breadth of Section 230 immunity. Nonetheless, the
Administration's proposal in particular provides a look at some of the
far-reaching changes to Section 230 that are under consideration.

Subject: FCC Opens New Chapter In Repurposing Spectrum In The 3 GHz Band

In the wake of the recent completion of the 3550-3650 MHz auction of
Priority Access Licenses ("PALs") in the Citizens Broadband Radio
Service ("CBRS") making 70 megahertz of so-called mid-band spectrum
available, and the adoption of the regulatory framework in the
3700-4200 MHz band that will make available another 280 megahertz for
flexible use commercial wireless operations, the FCC has announced its
intention to take significant steps in realigning the 3450-3550 MHz
range for non-federal flexible fixed and mobile use on a shared basis
with existing federal radiolocation operations.

Subject: FCC Establishes $9 Billion Fund To Support 5G Services In
Rural America

As the Federal Communications Commission ("FCC") continues to take
steps to facilitate the deployment of next-generation 5G services
nationwide, it is also working to ensure that rural America is not
left behind. On October 27, 2020, the FCC adopted an Order
establishing the 5G Fund for Rural America ("5G Fund"), which will
make available up to $9 billion in federal subsidies over 10 years to
bring voice and 5G broadband services to unserved rural areas. It also
requires mobile carriers receiving legacy support to use an increasing
percentage of their $368 million in funding for 5G services. The funds
are expected to support the deployment of 5G networks that will not
only provide rural areas with critical access to telehealth, telework,
remote learning opportunities, and precision agriculture, but will
also drive job creation and economic growth.
