In the current environment of reckoning for the societal power of Big
Tech, one threat seems ever-present on the tongues of those who would
cut these companies down to size. Enacting this threat is likely to
have the opposite effect that many people intend, but it is still
worth our consideration as an answer to problems in way the digital
world affects society.

New Massachusetts Telehealth Law Signed: Top 3 Changes
Massachusetts has a new telehealth law on the books, signed into law
by Governor Charlie Baker as part of a comprehensive healthcare
bill. The telehealth provisions constitute only a portion of the
70-page legislation, but represent the first major formalization of
telehealth laws in Massachusetts. The Act was successfully signed into
law on January 1, 2021, following several years of proposed
legislation and unsuccessful attempts at laws on insurance coverage
and practice standards. This article highlights the top three changes
in the Act for telemedicine and digital health companies.

on TCPA and Calls to Recruit Clinical Drug Trial Participants

The Federal Communications Commission's (FCC) Bureau of Consumer and
Governmental Affairs (Bureau) has granted a Petition For Declaratory
Ruling submitted in 2014 by Acurian, Inc. (Acurian) "asking the
Commission to clarify that a call to a residential telephone line
seeking an individual's participation in a clinical pharmaceutical
trial is not subject to the [Telephone Consumer Protection Act's
(TCPA)]... restrictions on prerecorded calls." Acurian argued that
"its calls are not made for a commercial purpose or, alternatively, do
not include or introduce an advertisement or constitute telemarketing,
and thus do not require the individual's prior express written
consent."

As we've noted a few times, there's an underlying belief in American
tech policy that if we just keep throwing money at entrenched
broadband monopolies we can lift US broadband out of the depths of
mediocrity. But as we've noted more than a few times, heavily
subsidizing a bunch of regional monopolies, while not doing anything
about the conditions that created and insulate those monopolies,
doesn't result in much changing. It's especially ineffective when you
don't really punish ISPs for decades of taking taxpayer money in
exchange for network upgrades that almost always, like clockwork, wind
up unfinished.
