Subject: Leaked: EU To Charge Meta/Facebook Over Secret Agreement

While the European Commission announced back in March that they would
investigate Facebook, sources have leaked that it is ready to announce
formal charges, according to Politico and Reuters. Earlier this year,
Executive Vice-President of the EU Commission Margrethe Vestager
stated that an agreement between Google and Meta, called “Jedi Blue,”
targets competing advertisers on the marketplace site and may be an
abuse of power that violates EU antitrust laws. The Commission is
reportedly ready to lay out how Meta allows Facebook to buy up
advertising space, which keeps prices high and choices low for
consumers. Jedi Blue also potentially restricts other companies from
advertising through Meta. The United Kingdom has raised similar
charges against Facebook, and Brussels is investigating the social
media giant over Jedi Blue.

We are pleased to present our latest Telephone and Texting Compliance
News, providing insights and news related to the Telephone Consumer
Protection Act (TCPA). In this issue’s Regulatory Update, we discuss
an FCC Enforcement Bureau Public Notice to all U.S.-based voice
service providers regarding Urth Access, LLC, an originator of
student-loan-related robocalls. The so-called K4 Notice informed
service providers that they may block voice calls or cease accepting
traffic from Urth without liability and that they could face
enforcement action for continuing to accept or facilitate traffic from
Urth. This enforcement action could include removal from the Robocall
Mitigation Database, which would bar intermediate and terminating
providers from accepting traffic from the removed voice services
providers. The Enforcement Bureau also issued a cease-and-desist
letter directing Urth to stop transmitting illegal traffic and take
steps to prevent its network from being a source of illegal
robocalls. The agency also adopted a Notice of Inquiry seeking
information on the non-IP technology in the nation’s phone networks.

Subject: United States: FCC Proposes Updated Network Outage Rules

The FCC adopted a Second Report and Order at its Open Meeting on
November 17, promulgating rules requiring service providers to deliver
more timely and actionable information to 911 facilities during
network outages. The Commission hopes the new rules will streamline
the network outage notification process and align the requirements
imposed on different service providers. Maintenance of 911 Special
Facility Contact Information
The new rules require both covered 911 service providers (“C9SP”) and
Originating Service Providers (“OSPs”) (i.e., cable, satellite,
wireless, wireline, and interconnected VoIP providers) to gather and
maintain up-to-date, accurate contact information for 911 special
facilities. The providers must confirm the accuracy of this contact
information at least annually. In this context, “special facilities”
are entities enrolled in the TSP Program at priority Levels 1 and 2,
which include major military installations, key government facilities,
and public safety answering points (“PSAPs”), among others.
