Subject: Additional Huawei Affiliates Added to Entity List

Over the past few weeks, the U.S. government has taken additional
actions targeting Huawei Technologies Co., Ltd. (Huawei) and its
affiliates.
The May 16, 2019 addition of Huawei and many of its
non-U.S. affiliates to the Entity List and related actions was
discussed in our May 24, 2019 alert.

Subject: Does Use Of Soundboard Technology Violate The TCPA?
On September 13, 2019, Florida-based company Yodel Technologies LLC
("Yodel") petitioned the Federal Communications Commission ("FCC") for
a declaratory ruling concerning the use of soundboard technology.
Specifically, the petition addresses the question of whether sound-
board technology should be considered a pre-recorded voice message, or
"robocall," within the meaning of the Telephone Consumer Protection
Act ("TCPA"). This petition comes on the heels of a similar petition
submitted in February 2019, by NorthStar Alarm Services, LLC in which
they sought a declaratory ruling regarding whether soundboard tech-
nology violates the TCPA. As of this date, that petition still remains
pending.

I spent a few years as a broadcast engineer when I was in my 20's, and
I can generally spot Soundboard ads as soon as I hear them.
I always ask the recording to help me settle an argument, and tell me
the sum of two plus negative two: the whole process usually grinds to
a halt at that point.
Of course, like spam, it's an arms race: the last time I did this, I
got a pre-recorded announcement that the system was being used to help
a speaking-impaired individual. I started laughing, and the caller
hanged up.
