Subject: Michigan Joins Combined $16 Million Multi-State Settlements
Over 2012 and 2015 Data Breach Experience
LANSING - Michigan Attorney General Dana Nessel announced today that
Michigan, along with a coalition of other attorneys general, has
reached two separate settlements with an expert regarding data
breaches it faced in 2012 and 2015 that compromising the personal
information of millions of consumers across the country. The alliance
also reached an exclusive settlement with T-Mobile related to the 2015
breach, which affected more than 15 million people who submitted
T-Mobile credit applications. Under the agreements, the companies
agreed to improve their data security practices and to pay the states
a total of more than $16 million. Michigan will receive a total of
$359,896 in settlements.

NEW YORK - The National Advertising Division (NAD) of BBB National Programs
recommended that T-Mobile US, Inc. modify or discontinue certain claims for
its Magenta Max mobile wireless service plan, including claims that:
"You'll get T-Mobile's Price Lock Guarantee, they won't raise the
rates of your rate plan, ever" (the "Price Lock Guarantee" claim).
"When you switch your family to T-Mobile Magenta Max, you can get
up to $1,000." "Families [with T-Mobile] save 20% versus AT&T."
The claims at issue, which appeared in two T-Mobile television
commercials (the "Please Listen" ad and the "Cumpleanos" ad), were
challenged by competitor AT&T Services, Inc.

Subject: The Oklahoma Telephone Solicitation Act ("OTSA") Is Now In
Effect, Will Lawsuits Be Next?

A small handful of states have enacted their take on the Federal
Telephone Consumer Protection Act ("TCPA"), prohibiting the use of
automated telephone sales calls without prior express written
consent. These laws are designed to protect consumers from receiving
unauthorized and unwanted telemarketing calls. Oklahoma recently
passed such legislation, the OTSA, which is based in large part on the
Florida Telephone Solicitation Act ("FTSA"). Readers of our blog know
that the FTSA imposed additional restrictions on telemarketing beyond
those contained in the TCPA and created a state-based avenue for
telemarketing litigation. Over the last year, FTSA lawsuits have
changed the telemarketing landscape in Florida. In all likelihood, we
can expect to see a similar bombardment of lawsuits alleging
violations of the OTSA.

FCC PETITIONS TRACKER
Kelley Drye's Communications group prepares a comprehensive summary of
pending petitions and FCC actions relating to the scope and
interpretation of the TCPA. Highlights of this month's summary are
provided below.
Number of Petitions Pending
29 petitions pending
* One petition for reconsideration of the rules to implement the
government debt collection exemption
* One application for review of the decision to deny a request for an
exemption of the prior express consent requirement of the TCPA for
"mortgage servicing calls"
* One request for reconsideration of the 10/14/16 waiver of the prior
express written consent rule granted to 7 petitioners.
On January 26, 2022, the National Consumer Law Center and other
consumer groups filed an ex parte letter requesting that the FCC
expressly exclude prerecorded scam calls and automated texts from the
exemptions from the consent requirement for these calls and texts in
42 U.S.C. § 227(b).
