Zillow Up the List of Top Robocallers: 9MM Calls in August, 2020 Make
Zillow 5th Largest Robocaller in the Nation (Maybe)
The working assumption is that these are alerts to agents notifying
them of potential homes coming onto the market or potential home
buyers expressing interest in services, but given the massive volume -
nearly 9mm calls in one month - the volume of alerts seems
exceptionally high.

Subject: A Divided Eleventh Circuit Holds that Incentive Awards are Prohibited
In a decision that may have far-reaching consequences, a divided panel
of the Eleventh Circuit ruled that incentive awards to named plain-
tiffs - which are routine in TCPA and other class action settlements -
are improper. See Johnson v. NPAS Solutions, LLC, No. 18-12344, 2020
WL 5553312, at *1 (11th Cir. Sept. 17, 2020). Despite acknowledging
that incentive payments are commonplace in modern class action
litigation, the majority held that such awards are prohibited under
"on-point Supreme Court precedent" from the late 1800s and required
reversal of the district court's approval of a $1.4 million class
settlement.

Laughing All the Way to the Bank - TCPA Defendant Pays $75,400.00 for
One Call Case Explaining Precisely Why There Are So Many Frivolous
TCPA Cases Out There
Just last week I wrote about how the Eleventh Circuit is trying to take
away incentive for TCPA class actions since they are clogging the
dockets of federal courts across the country. Well, for those of you out
there that wonder how we ended up here in the first place, boy do I have
a story for you.
