Framework to Ensure Data Access, Transparency, and Accountability (SAFE DATA)

Subject: Facebook and the United States Submit Briefs in Facebook,
Inc. v. Duguid
The Supreme Court's decision to grant certiorari in Facebook, Inc. v.
Duguid has been in the forefront of the TCPA world since July when news
of the decision hit. With this granting of certiorari comes the promise
to resolve the growing circuit split over the interpretation of the
definition of an ATDS. Now, Facebook and the United States Government
have filed briefs, bringing the case one, albeit small, step closer to
resolution.

Subject: Texas District Courts Remain Divided on Standing for
Single-Text TCPA Plaintiffs
In a pair of recent opinions, two U.S. district courts in different
parts of Texas expressed inconsistent views on a topic we have been
following closely: whether plaintiffs who receive just a single unwanted
text message can establish a concrete injury for Article III standing.
