Subject: The Telemarketer's Guide To TCPA Consent
by David O. Klein (New York)
Because of the growing ability - and need - to reach consumers through
telemarketing technology, businesses (and their call centers) face the
growing risk of contacting consumers without proper TCPA consent.

Subject: FCC Closes Out The Summer With STIR/SHAKEN Revocation In
August Open Meeting
by Joshua Guyan (Los Angeles) and Carolyn Mahoney (Los Angeles)
Today, the FCC is holding its last Open Meeting of the summer. Here is
the agenda. ... The Commission will also hear a Third Report and Order
that would authorize the agency's private Governance Authority
overseeing the STIR/SHAKEN framework to review and revoke a voice
service provider's participation in STIR/SHAKEN. The Order would
further establish an appeals process and procedures for providers
affected by a revocation.

Subject: Arizona Court Splits With Majority On Autodialer TCPA
Violations
by David O. Klein (New York)
The law rarely moves in a uniform direction. This is especially true
when it comes to the Telephone Consumer Protection Act
("TCPA"). Several recent decisions interpreting the TCPA's autodialer
prohibition have come to the same conclusion: equipment is only an
autodialer if it uses a random or sequential number generator to
produce the number that is called or sent text messages. But a recent
decision from an Arizona court, captioned Jance v. Homerun Offer,
takes a different approach on TCPA violations.
