Subject: US Commerce Dept Issues Narrow License For Certain
Transactions With Huawei
The Department of Commerce Bureau of Industry and Security (BIS) has
issued a 90-day temporary general license exempting a set of transac-
tions from the Entity List designation of Huawei Technologies Co.,
Ltd. ("Huawei") and its affiliates worldwide, which was effective May
16, 2019. The Entity List designation effectively prohibits the ex-
port, reexport, or transfer of hardware, software, and technology
subject to the U.S. Export Administration Regulations (EAR) to Huawei
and its affiliates, as explained in our earlier client alert. The
temporary general license aims to mitigate the impact of the Entity
List designation on the operations of U.S. and foreign telecom-
munications providers with Huawei hardware and software, but does
not provide broad relief from Entity List prohibitions. The general
license is effective from May 20, 2019, to August 19, 2019.

Subject: TCPA Text Message Lawsuit

This week, an Illinois woman filed a putative class action lawsuit in
federal district court in the State of Florida against Ranieri Law LLC
("Ranieri"), a credit repair services company. The plaintiff, Nanci
Rowe ("Plaintiff"), alleged that Ranieri sent unsolicited text
messages to her cellular telephone in violation of the Telephone
Consumer Protection Act ("TCPA"). Plaintiff is seeking statutory
damages and injunctive relief, on her own behalf and that of a class
of similarly situated individuals. The case is pending in the Southern
District of Florida, Case Number: 19-cv-61219.

Section 889 of the 2019 National Defense Authorization Act (NDAA)
generally prohibits federal agencies, federal contractors, and grant
or loan recipients from procuring or, potentially, using certain
"covered telecommunications equipment or services" - specifically
those produced by Huawei Technologies Company and ZTE Corporation, and
with respect to certain public safety or surveillance applications,
Hytera Communications Corporation, Dahua Technology Company, and
Hangzhou Hikvision Digital Technology Company - as a "substantial or
essential component of any system, or as critical technology as part
of any system."
