Subject: US Supreme Court Holds That Copying "Declaring Code" Is
Fair Use

On April 5, 2021, the US Supreme Court decided the long-running and
closely-watched case of Google v. Oracle, holding that it was a fair
use for Google to copy the "declaring code" from the application
program interface (API) of Oracle's Java SE platform when implementing
Java for Google's Android operating system. The Court sidestepped the
question of whether Oracle's copyright protected such code at all,
instead assuming that it did. The Court then conducted a fair use
analysis that, depending on one's perspective, was either an "ordinary
application of copyright's limiting doctrines," or "wholly
inconsistent with the substantial protection Congress gave to computer
code." Although the Court went to great lengths to cabin its holding
to the very narrow type of code at issue, the decision is sure to
feature prominently in fair use analyses in copyright infringement
cases in the years to come.

Last week, two organizations hosted a White House briefing on
President Biden's proposed $2 trillion infrastructure package, the
American Jobs Plan (the "Plan"). The organizations were Small Business
for America's Future and Business Forward. During the briefing,
National Economic Council Deputy Director Bharat Ramamurti repeatedly
emphasized the importance of expanding access to broadband to 100
percent of Americans and reducing the cost of broadband service.
Access to affordable broadband is essential to the White House's
vision of modernized American infrastructure.

We are pleased to present our latest Monthly TCPA Digest, providing
insights and news related to the Telephone Consumer Protection Act
(TCPA). In our Regulatory Update, we cover the FCC's record $225
million fine against a pair of robocallers that made false claims
about health insurance offers and its cease-and-desist letters to
eight voice providers for transmitting illegal robocall traffic. We
also discuss a joint statement by a bipartisan group of Congressional
lawmakers expressing concern about the U.S. Supreme Court's ruling in
Facebook v. Duguid, which held that in order to meet the TCPA's
definition of an automatic telephone dialing system (ATDS), a device
must be able to store or produce telephone numbers using a random or
sequential number generator. In addition, we look at an FCC Order
requiring compliance with various provisions of the TRACED Act, which
aims to reduce unwanted and illegal robocalls, including Section 10
and a mandate requiring voice service providers to notify callers
immediately when calls are blocked.
