Reilly and Madelaine A. Newcomb A Telephone Consumer Protection Act (TCPA) defendant's do not call (DNC) policy was not enough to avoid potential TCPA liability, an Illinois federal court recently held. Adam Ailion filed suit against Healthcare Solutions Team (HST) and National General Holdings Corporation (Nat Gen) after he allegedly received telemarketing calls from HST for the purpose of selling Nat Gen insurance policies. Ailion, whose number was registered on the National DNC Registry, claimed that he requested that both defendants put his residential number on their internal DNC lists. https://www.mondaq.com/article/news/1315162?q=1803232&n=803&tp=22&tlk=10&lk=104

Mon and Paul Singer In January 2022, the Texas Attorney General filed a lawsuit against Google alleging that the company engaged iHeartMedia DJs to provide endorsements for its Pixel 4 phone, even though they had never used it. In November 2022, the FTC and several state attorneys general announced settlements with Google and iHeartMedia over the same conduct. Although Texas settled with iHeartMedia, it continued to separately pursue its case against Google. Last week, the parties agreed to a settlement. According to the FTC and states, Google hired iHeartMedia and other radio networks in 2019 to have DJs read ads for the Pixel 4 phone. GooglePixel 4 provided scripts that included endorsements written in the first-person. For example: "It's my favorite phone camera out there, especially in low light, thanks to Night Sight Mode;" "I've been taking studio-like photos of everything;" and "It's also great at helping me get stuff done, thanks to the new voice activated Google Assistant that can handle multiple tasks at once." https://www.mondaq.com/article/news/1320378?q=1803232&n=803&tp=22&tlk=15&lk=109

By Luke Bouma Amazon really wants you to join the Amazon Prime family and buy all of your stuff from them. To help with this, Amazon is reportedly in talks with Dish, T-Mobile, and Verizon to sell wireless phone plans for free or as little as $10 a month. This comes from Bloomberg, who talked with people who had knowledge of the plans. Reportedly Amazon is hoping by offering free or very cheap phone plans they can build loyalty with their customers. Helping Amazon grow and keep customers locked into the Amazon ecosystem. https://tinyurl.com/32mx4n6n

This, of course, makes it the first major social media platform to do so. Twitter updated its ad policy to permit approved cannabis brands to target advertisements in the United States, subject to the following list of restrictions:
  • Advertisers must be licensed by the appropriate authorities, and pre-authorized by Twitter.
  • Advertisers may only target jurisdictions where they are licensed to promote these products or services online.
  • Advertisers may not promote or offer the sale of Cannabis

    • There is an exception for ads for topical (non-ingestible) hemp-derived CBD topical products containing equal to or less than the 0.3% THC government-set threshold.

  • Advertisers must comply with all applicable laws, rules, regulations, and advertising guidelines.
  • Advertisers may not target customers under 21.

Moderator's Note

Elon Musk has announced a joint venture between Twitter and Space-X

Some critics of the high price Musk paid for Twitter have conceded that they can's argue with the sweet smell of success!

I have a great idea for Twitter's new jingle: it'll be a medley of Arlo Guthrie's "Coming Into Los Angeles," along with The New Riders of the Purple Sage's classic "Panama Red," performed by The Doobie Brothers!
